Spellbound Holdings Limited trading as TrustFord is the controller and responsible for your personal data. We are committed to protecting and respecting your privacy. Hertz Rent A Car in the Channel Islands is operated under licence by Spellbound Holdings Limited

From time to time we also work with, or act on behalf of, third parties to assist them in providing goods and services to you such as insurance providers and commercial fleet customers. In these circumstances we would normally act as a data processor on behalf of the relevant third party and will therefore only process your data in accordance with their instructions.

Information we collect from you

The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

·       Transaction Data includes details about payments to and from you and other details of vehicles, parts and other products and services you have purchased from us.

·       Technical Data includes internet protocol (IP) address, unique visitor ID generated when you visit our websites, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, device, operating system and platform and other technology on the devices you use to access our websites, referring website details, details of searches carried out by you on our websites.

·       Profile Data includes your username and password, purchases or orders made by you, vehicle data points of individual vehicles viewed by you on our website (e.g. make, model, price, reg number), your interests, preferences, feedback and survey responses.

·       Usage Data includes information about how you use our website, products and services.

·       Marketing and Communication Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

·       CCTV for the prevention of crime and monitoring of assets and colleagues

 

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

Unless we expressly inform you otherwise we will not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data).

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

Promotional offers from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from us if you have requested information from us or purchased goods or services from us or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out of receiving that marketing.

Third-party marketing

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

We may collect information about you through systems which are provided and hosted by a third party, such as the provider of this site and e-commerce platforms which we utilise in certain areas of our business.

In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective buyer of such business or assets. In the case that we buy a business the seller may share your personal data with us, which we will process in line with our privacy notice.

If Spellbound Holdings Ltd or substantially all of its assets are acquired by a third party, in which case personal data held by them about their customers will be one of the transferred assets.

To advise appropriate parties of your contact details where a traffic or parking infringement has taken place.

For the prevention and detection of crime or for other legal purposes. This will include but not be limited to CCTV.

International transfers

Your personal information will be treated in accordance with Jersey law concerning data protection and may be transferred within the European Economic Area ("EEA"), as well as to countries outside the EEA (including to the USA). The countries to which we transfer your personal information may not be regarded by the European Commission as ensuring an adequate level of protection for personal information. As a result, when we transfer your personal information outside the EEA we will put in place appropriate safeguards in accordance with our legal obligations to ensure that your personal information is adequately protected, irrespective of the country to which it is transferred. These safeguards may include obtaining contractual assurances from any third party given access to your personal information that your personal information will be protected by standards which are equivalent to those that protect your personal information when it is in the EEA.

All hard copy information you provide to us is stored and disposed of securely in line with our retention policy.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request restriction of processing of your personal data. Information you provide to Ford Credit

You may also use www.trustford.co.uk to view Ford Credit finance products and we may assist you with applying for such products online or when you visit our dealerships. Ford Credit may request additional personal information from you in order to verify your identity and allow access to your Ford Credit account. Ford Credit will use this personal information as described when you apply for finance, or once you are a Ford Credit customer, as set out in your agreement with Ford Credit.
